We enjoyed your post (the “Post”) so much we would like to share it on one of our digital channels (including but not limited to Facebook, Twitter, Instagram, and fitovers.com) (collectively “Jonathan Paul® Sites”).

You represent and warrant that you are at least 18 years old. You have all legal rights to your Post. You represent and warrant that you own all the legal rights to your Post and its content. You represent and warrant that if Jonathan Paul® uses your Post it will not violate or infringe on the rights of any third party for any reason, including but not limited to copyright, trademark, privacy and rights of publicity. You further represent and warrant that any statements in your Post are accurate. You give Jonathan Paul® permission to use and/or reuse your Post. You grant Jonathan Paul® Fitovers and its, subsidiaries, affiliates, licensees and assigns (“Jonathan Paul®”), a royalty-free, perpetual, nonexclusive, unrestricted right and license throughout the universe to copy, reproduce, modify, edit, adapt, translate, create derivative work from, publish, post, distribute, publicly perform, sublicense, or otherwise provide to others your Post in any and all media, formats and channels.

You release Jonathan Paul® from any and all legal claims if we use your Post. You agree to hold Jonathan Paul® harmless from and against any claims, disputes, demands, proceedings, causes of action, judgments, damages, liabilities, losses, costs or expenses of any kind, known and unknown, suspected or unsuspected, disclosed or undisclosed, which may arise out of or are in any way connected to your Post and Jonathan Paul®’s use of it.

This Privacy Policy is entered into by and between you and Jonathan Paul® Fitovers in order to help you make an informed decision about using this website and Jonathan Paul® services and to explain to you what information we collect, how we store that information, and how we may use it. By using fitovers.com or any other page on which this policy appears (the “Jonathan Paul® Sites”) you are consenting to have your personally and non-personally identifiable data transferred to and/or processed in the United States in accordance with the terms of this Privacy Policy.

A.  The Information We Collect from You

When you enter the Jonathan Paul® Sites, we may collect certain non-personally identifiable information. What types of cookies do we use on Jonathan Paul® Sites?

Managing Cookies

4.  Other Methods of Collecting Data
In addition to cookies, the Jonathan Paul® Sites employ pixel tags and/or web beacons to collect non-personally identifiable data.
Pixel tags or web beacons are small strings of code that provide a method for delivering a graphic image on a Web page or other document. Pixel tags and web beacons allow the operator of the Web page or other document, or a third party who serves the pixel tag, to set, read, and modify cookies. Pixel tags and web beacons may also be used to obtain information about the computer being used to view that Web page or other document. The entity that sends the tag can view the IP address of the computer that the tag is sent to, the time it was sent, the user’s operating system and browser type, and similar information. fitovers.com employs web storage to collect and store non-personally identifiable data in your browser.  Web storage functions similar to cookies as described above, however, by storing information in your browser we are given more space than traditional cookies.  We utilize both persistent and session web storage. fitovers.com employs application caches to collect and store non-personally identifiable data.

5.  Privacy of Children and Sensitive Consumer Information
Jonathan Paul® Fitovers does not knowingly collect information from anyone under the age of 13.  fitovers.com does not knowingly obtain or store any Sensitive Consumer Information, such as Social Security Numbers and other government issued identifiers; insurance plan numbers; financial account numbers; information that describes the precise real-time geographic location of an individual; or precise information related to health or medicals conditions.
If we are made aware that we have received information from anyone under the age of 13 or Sensitive Consumer Information in violation of this Privacy Policy, we will use reasonable efforts to locate and remove that information from our records.

B.  Use of Information Collected

1.  Primary purpose
The information and data collected by the Jonathan Paul® Sites is primarily for the purposes of:

  • Ensuring that content and services from our site is presented to you in the most effective manner for you and your computer;
  • Providing you the services you request;

Unless explicitly called out in additional rules and regulations for marketing campaigns or sweepstakes, we do not rent, share, sell, or trade personally identifiable information with third parties for their promotional purposes.

Jonathan Paul® Fitovers reserves the right to disclose your personal information, without prior notice to you, as required by law or when we believe that disclosure is necessary to comply with a law, regulation, or any legal request (e.g. court order or subpoena) served on our web site.  Furthermore, we may share your personal information when we believe it is necessary to address fraud or other illegal or prohibited activity perpetrated through Jonathan Paul® Sites or to prevent imminent bodily harm.  However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.
